Responsible use & legal information

Important distinctions between a self-hosted distribution website, clinical data responsibilities and historical software rights.

Important: This is a draft legal notice for review by qualified legal counsel before a public production release. It does not eliminate non-waivable legal duties or guarantee regulatory compliance.

1. Scope of this website

Rhinobase.net is a public information, documentation and software distribution website for Rhinobase Next. The website is not a clinical patient portal or managed cloud electronic medical record service. The project does not invite users to submit identifiable patient data to this public website.

2. Healthcare data and privacy

Rhinobase Next is intended for deployment on infrastructure selected, configured and operated by each downloading institution or user. The operator of a specific installation is responsible for determining its lawful role and obligations under all applicable laws, including Türkiye's Personal Data Protection Law (KVKK), the EU General Data Protection Regulation (GDPR), and the US Health Insurance Portability and Accountability Act (HIPAA), where these laws apply.

Operators must determine a lawful basis for processing health information and apply appropriate administrative, technical and physical safeguards, access controls, encryption, retention policies, backup arrangements, incident response processes and lawful processing notices. Relevant legal responsibilities may also apply to software developers, service providers, processors and others depending on the facts; downloading software does not automatically transfer or extinguish every legal duty.

The website and its self-hosting model are not a HIPAA certification, GDPR certification, KVKK certification or guarantee of compliance.

3. Deployment and security responsibility

Users must verify the origin and integrity of installation packages, configure their own systems safely, keep software and operating systems updated, administer access rights, maintain backups, secure exports and periodically assess risks. Public internet exposure, insecure passwords and unprotected clinical image storage may create substantial legal and technical risks.

Do not enter real patient information into untested or unapproved demonstration environments. Do not use sample records containing identifying clinical information in screenshots, manuals or tutorials without appropriate authorization and a lawful basis.

4. Software status and warranty limitations

Documentation and available installation utilities are supplied for evaluation and self-administration. Unless a separate, express written agreement provides otherwise, software and documentation are provided “as is” and without any representation that they are suitable for a particular clinical, regulatory or technical use. Limitations of liability and warranties apply only to the extent permitted by applicable law and an applicable software license. Nothing here seeks to waive rights or duties that cannot lawfully be excluded.

Rhinobase Next website content and original software components are protected by copyright. No open-source grant or commercial redistribution permission should be inferred from the availability of downloadable installation tools. The exact software license, rights to modify, redistribute or commercialize, and any third-party dependencies must be stated in the final verified application release.

The historical Windows software lists Copyright © 2000–2018 Fazil Apaydin, Serdar Akyildiz, David A. Hecht and Dean M. Toriumi and has its own historical license restrictions. Its license does not automatically establish the license terms for Rhinobase Next.

6. Professional and clinical use

Rhinobase Next is a documentation and analysis aid, not a substitute for clinical judgment. Users remain responsible for validating entered data, interpreting any calculations, checking reports and determining whether any applicable medical-device laws or institutional approvals affect their intended use.

7. Third-party components and references

Third-party libraries and tools remain governed by their respective licenses. External links to regulators and technical documentation are provided for reference and do not constitute endorsement of Rhinobase Next.

8. Publisher details and final review

Before publication: add verified publisher/operator legal identity, contact email, applicable jurisdiction, final software license, any applicable website privacy/cookie policy and a release date. Obtain qualified legal review for actual distribution terms and the jurisdictions served.
